SymmetriQ Ltd (companynumber 123890, registered in Gibraltar) (“SymmetriQ”, the “Company”,“we”, “us” or “our”) operates the website at https://symmetriq.io/ (the “Site”). The Site provides informationabout and the ability to download our quantum-resistant, non-custodial retailwallet (the “SymmetriQ Wallet” or “Wallet”) and relatedcrypto-security solutions, including Wallet-as-a-Service (WaaS), blockchainsecurity audits, risk assessments, consultancy, and secure API integrations. These terms of service (the “Terms”) govern your access to anduse of the Site and any SymmetriQ Wallet you download or access through it. Byusing the Site or Wallet, you confirm that you accept these Terms and agree tocomply with them. If you do not agree, you must not use the Site or Wallet.

Our SymmetriQ Wallet is a non-custodial, decentralised hot wallet that adds a patented multi-layer,quantum-resistant signature and zero-knowledge notary service to protect assets even if your private keys are compromised. Important Wallet warning: Because the Wallet is non-custodial, suspension of the Site or notary service does not affect your ability to access your assets via your private keys on the underlying blockchain (subject to network conditions). However, certain enhanced security features (for example dual quantum-resistant signatures) may become unavailable during downtime.

You must not:
- copy, modify, reverse-engineer, decompile, or create derivative works of the Wallet software or quantum-resistant components;
- attempt to circumvent any security layer, including the dual-signature or notary process;
- use scraping, bots, or automated tools to access or extract data;
- remove copyright, trademark or proprietary notices;
- use the Site or Wallet for any unlawful purpose, including money laundering, terrorist financing or sanctions evasion; or
- the introduction of viruses or harmful code, or any interference with the proper functioning of the Site or Wallet.
Any rights not expressly granted are reserved.

Critical warnings for the SymmetriQ Wallet:
- Non-custodial nature: the SymmetriQ Wallet is fully non-custodial. You alone generate, store and control your private keys, seed phrases, recovery phrases and device access. You are solely responsible for the security of these items. Loss, theft or compromise of your private keys or seed phrase may result in loss of access to your digital assets. However, if you have enabled the optional timelock feature on a transaction, that transaction will be subject to an on-chain delay of up to three weeks, during which the funds remain protected on the blockchain even in the event of key compromise. SymmetriQ has no ability to recover funds in circumstances where the timelock has not been used or has already expired.
- Quantum-resistant claims: While we use post-quantum cryptographic techniques (aligned with emerging NIST standards), no technology is 100% future-proof against all possible advances in quantum computing or other threats. We do not guarantee that the Wallet will protect against every conceivable attack.
- Crypto risks: Digital assets are volatile, may become illiquid or worthless, and transactions on public blockchains are irreversible. You may lose all value due to market movements, smart-contract failures, or network issues.
- Security features: The additional quantum-resistant signature and zero-knowledge notary provide enhanced protection (including real-time KYC/AML checks), but they do not eliminate all risks (e.g., user error, phishing outside our system, or device compromise).
- Regulatory compliance: We perform certain compliance checks via our notary service, but you remain responsible for your own regulatory obligations.
You should not rely on any content when making financial decisions. Always obtainin dependent professional advice and conduct your own due diligence. We disclaim all liability for any loss arising from reliance on the Site or Wallet information.

If you are a consumer user: We provide the Site and Wallet for domestic and private use. We have no liability for any business losses. For defective digital content that damages your device or other digital content due to our failure to use reasonable skill and care, we will repair the damage or pay compensation, subject to the limitations below.

- We are not liable for any loss of digital assets caused by your failure to secure private keys/seed phrases, unauthorised access to your device, or any blockchain/network failure.
- We are not liable for losses resulting from your use (or inability to use) the quantum-resistant signature or notary service where such loss arises from user error, third-party attacks outside our control, or changes in underlying blockchain protocols.
- The Wallet is provided “as is” and “as available”. We disclaim all warranties, including merchantability, fitness for purpose, and non-infringement, to the maximum extent permitted by law.
No custody or insurance: Digital assets held in the Wallet are not insured by us and are not protected by any deposit guarantee scheme.

13. Which country’s laws apply to any dispute?
If you are a consumer: These Terms are governed by English law. You may bring proceedings in the courts of England and Wales (or, if you reside in Northern Ireland or Scotland, in those jurisdictions as well).
If you are a business: These Terms (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
